ONLINE STORE TERMS AND CONDITIONS
The owner of the online store „Karl Evisalu“ is HeavyCraft OÜ (16345528), located at Pärnu mnt. 62a, 10135 Tallinn.
- Validity of the Sales Agreement, Product, and Price Information
The terms and conditions apply to the purchase of goods from the Online Store.
The prices of the products sold in the online store are indicated next to the products. In addition to the prices displayed for the products, there will be a fee for the delivery of the goods. All prices for the products sold in the online store are stated in euros.
The delivery fee depends on the buyer’s location and the method of delivery. The delivery fee is displayed to the buyer when placing an order.
Information about the product is provided directly next to the product in the online store.
- Order Placement
To order a product, the desired items must be added to the shopping cart. To complete the order, the required data fields must be filled in, and a suitable method of product delivery must be selected. The screen will then display the amount to be paid, which can be securely paid through the following payment methods:
– Estonian bank transfers: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele, Pocopay
– Visa/Mastercard card payments
– Paypal payments
NB! When paying with a bank link, be sure to click the “Back to Merchant” button on the bank’s page.
Payment services are provided by SEB bank. Payment is made outside the Online Store in a secure environment – when paying with a bank link, in the secure environment of the respective bank, and when paying with a credit card, in the secure environment of PayPal. The seller does not have access to the customer’s bank and credit card data. The agreement enters into force upon receipt of the payment amount into the Online Store’s settlement account.
The owner of the Online Store is the data controller and transfers the necessary personal data for payment processing to the authorized processor, SEB bank.
If the ordered goods cannot be delivered due to the product being out of stock or for any other reason, the buyer will be notified as soon as possible, and the paid amount (including the cost of delivery) will be refunded immediately, but no later than within 14 days from the date of sending the notification.
- Delivery
Goods are shipped to the following countries:
EUROPE: Cyprus, Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Luxemourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden.
USA, ESTONIA, LATVIA, LITHUANIA
The buyer has the following options for receiving the goods: DPD(pickup stations), ITELLA(pickup stations), OMNIVA(pickup stations & courier). Other custom delivery methods can be arranged by contacting customer support.
The buyer bears the shipping costs, the corresponding price information is displayed next to the shipping method.
Domestic shipments in Estonia generally arrive at the buyer’s specified destination within 1-3 business from the effective date of the sales agreement. Deliveries outside of Estonia are typically completed within 14 calendar days.
In exceptional cases, the seller has the right to deliver the goods within a period of up to 45 calendar days.
- Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.
NB! Depending on the products, the buyer may not have the right of withdrawal. In such cases, the relevant products and services must be listed, and they must meet the conditions listed in § 53 (4) of the Law of Obligations Act.
The right of withdrawal does not apply if the buyer is a legal person.
To exercise the 14-day right of withdrawal, the ordered goods must not be used in any way other than what is necessary to verify the nature, characteristics, and functioning of the goods, as is permitted in a physical store for testing.
If the goods have been used for any purpose other than what is necessary to verify their nature, characteristics, and functioning, or if there are signs of use or wear, the Online Store has the right to reduce the refundable amount according to the decrease in the value of the goods.
To return the goods, a statement of withdrawal from the purchase must be submitted to the email address info@karlevisalu.com, no later than 14 days from the receipt of the goods. The submission should include proof of purchase and customers contact information.
The buyer bears the costs of returning the goods unless the reason for the return is that the returned item does not correspond to the one ordered (e.g., wrong or defective product).
The buyer must return the goods within 14 days following the submission of the statement of withdrawal or provide evidence that the goods have been handed over to the carrier during the aforementioned period.
Upon receiving the returned goods, the Online Store will refund all fees received from the buyer under the contract without delay, but no later than 14 days from the receipt of the withdrawal statement. The Online Store may withhold the refund until the goods being returned are received or until the buyer has provided evidence of returning the goods, depending on which occurs earlier.
If the buyer has explicitly chosen a method of delivery other than the cheapest standard delivery offered by the Online Store, the Online Store is not required to reimburse the buyer for any additional costs exceeding the usual delivery method.
The Online Store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the online store has been significantly marked down due to an error.
- Right to File a Complaint
The Online Store is responsible for the non-conformity or defects of the goods sold to the buyer that existed at the time of delivery and that become apparent within two years from the delivery of the goods to the buyer. Within the first year from the delivery of the goods to the buyer, it is presumed that the defect existed at the time of delivery. It is the Online Store’s obligation to rebut this presumption.
In the event of a defect becoming apparent, the buyer has the right to contact the online store within two months by sending an email to info@karlevisalu.com
The Online Store is not liable for defects that occur after the goods have been delivered to the buyer.
If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees associated with the sales agreement to the buyer.
The Online Store will respond to a consumer complaint submitted in writing or in a form that allows written reproduction within 15 days.
- Direct Marketing and Processing of Personal Data
The online store uses the personal data provided by the customer (such as name, address, phone number, and email address) for direct marketing purposes. By providing this information, the customer agrees to receive marketing materials, such as newsletters and special offers, from the online store. The customer has the right to opt-out of receiving such marketing materials at any time by contacting the online store or using the unsubscribe option provided in the marketing emails.
The online store is committed to protecting the privacy of its customers and handling their personal data in accordance with applicable data protection laws and regulations. The online store is the data controller responsible for the processing of personal data. Personal data is processed solely for the purpose of fulfilling orders and providing customer support.
The online store may share customer’s personal data with third-party service providers who assist in order fulfillment, delivery, and payment processing. These service providers are bound by confidentiality obligations and are not allowed to use the data for any other purpose.
The customer has the right to access, correct, and delete their personal data or request information about the data processing activities carried out by the online store. To exercise these rights or if the customer has any questions or concerns regarding the processing of personal data, they can contact the online store’s customer support.
- Dispute Resolution
In case of disputes related to purchases made from the online store, the customer has the right to contact the online store’s customer support for assistance and resolution. If a satisfactory solution is not reached through negotiation, the customer may use the online dispute resolution platform provided by the European Commission. The online dispute resolution platform can be accessed at http://ec.europa.eu/odr.
The laws of the Republic of Estonia shall apply to these terms and conditions and any disputes arising out of or in connection with them.
- Amendments to the Terms and Conditions
The online store reserves the right to amend these terms and conditions at any time. Any changes made will be effective immediately upon posting the updated terms on the online store’s website. Customers are advised to review the terms and conditions periodically to stay informed about any updates.
By continuing to use the online store after the amendments have been made, the customer agrees to be bound by the updated terms and conditions.

These online store terms and conditions constitute a legally binding agreement between the customer and HeavyCraft OÜ. By using the online store and making purchases, the customer agrees to comply with these terms and conditions.
